BACKGROUND
SquareGlow line products help one to be notified of incoming phone or videophone calls, or SquareGlow accessories by wireless flashing lights/alerts with vibrations or colors that you can customize.
GENERAL:
This Terms of Purchase of sale governs between you and Squareglow (“We” or “Us”);
PURCHASE
You agree to comply with any and all the guidelines, notices, operating rules and policies and instructions pertaining to the purchase of Products through this website, as well as any amendments thereto that we published, from time to time. We reserve the right to revise these guidelines, notices, operating rules and policies and instructions at any time and you are deemed to be aware of and bound by any changes to the foregoing upon publication on this website.
You agree that merchandise must be available for sale and we are not liable if it isn’t (i.e. Sold out but not reflected on this website). We also reserve the right to limit or refuse any order placed without any explanation. Items purchased online may be collected in-store but will require a valid billing and shipping address so GST can be paid.
PRODUCT DESCRIPTION
While We endeavors to provide an accurate description of the Products, We do not warrant that such description is accurate, updated or free from error. All merchandise is brand new (i.e. not pre-owned) and each product is to be of exceptional standards, passed through quality control.
Colors displayed on the website may not be the actual colors being delivered, unless otherwise specified in your order.
WHEN YOU MADE AN ORDER
You may place an Order by completing the Order form on this website and clicking on the “Check Out” button. We will not accept Orders placed in any other manner. We encourage you to review first the order cart before purchase. You shall be responsible for ensuring the accuracy of the Order.
CUSTOMER’S ACKNOWLEDGEMENT
You acknowledge and warrant that you have not relied on any term, condition, warranty, undertaking, inducement or representation made by or on our behalf which has not been stated expressly in a Customer Contract or upon any descriptions or illustrations or specifications contained in any document including any catalogues or publicity material produced by either Us or Manufacturer.
SHIPPING AND DELIVERY
We will arrange for the products to be delivered to the address for delivery indicated in your order. We will use reasonable endeavors to deliver products on or before the date for delivery set out in our order confirmation or, if no date is set out in our order confirmation, within 5-7 working days of the date of our order confirmation. There are some instances that shipping and delivery make take longer time due to unexpected reason such as custom clearances.
PRICES
All sales are FINAL with no hidden extra charge. Prices are FIXED and non-negotiable. Prices may change from time to time. We reserve the right to alter the prices at any time without prior notice.
ORDER ACCEPTANCE POLICY
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We also reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an
acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.
RETURN POLICY
All returns must be done in accordance with the instructions set out in these Terms of Purchase. We are not obliged to return unless all such instructions are followed. We will only deliver the replacement Product to your specified address.
Permitted returns: Subject to this clause, within 30 days from the date of delivery of the Product, you may return a Product when you:
- receive a product that is fundamentally different in nature from the Product specified
in the Customer Contract; or
- receive a faulty or damaged Product.
All items must be returned new, in resale condition. If not and is not severely damaged – it will only be qualified for exchange. If Customer received and refunded within 30 days, a 20% restocking fee will be applied. 100% refund if not received.
If exchange is necessary, You agree to reimburse us for the shipping. You are responsible for the return shipping costs in case of returns.
We offer One Year Warranty – exchange only.
You agree to you will call our customer service/Tech support for troubleshooting first before determine if it needs to be exchanged.
GOOD FAITH AND ASSISTANCE
You agree not to abuse our refund policy or any of these clauses. You hereby agree not to go to bank or any third party for refund after 30 days. You agree to notify your bank to abide with these terms. You agree to call us in case you need any assistance. Abusing the refund policy or going directly to bank without informing us will be reported to proper fraud agencies.
STATUTE OF LIMITATIONS
Regardless of any statute or laws to the contrary, you must file any claim or cause of action arising from this Agreement within (3) three months after such claim or cause of action arose or be forever barred. This section shall survive termination of this AGREEMENT.
INJUNCTIVE RELIEF
You acknowledge and agree that any violation or breach of these Terms of Purchase may cause Us immediate and irreparable harm and damages; consequently, notwithstanding any other provision of these Terms of Purchase or other applicable legal requirements, we have the right to, and may in our own discretion, immediately obtain preliminary injunctive relief (including, without limitation, temporary restraining orders) and seek permanent injunctive relief regarding any violation or breach of these Terms of Purchase. In addition to any and all other remedies available to us under law or in equity, we may seek specific performance of any term in this Agreement, including but not limited to by preliminary or permanent injunction.
ENTIRE AGREEMENT
These Terms of Purchase shall constitute the entire agreement between you and us relating to the subject matter hereof and supersedes and replaces in full all prior understandings, communications and agreements with respect to the subject matter hereof.
